AguaGuard Waterproofing Corporation Breach of Contract

AquaGuard Waterproofing Corporation breached their contract in a breath-taking number of ways.  In addition, though their sales representative sold the job in part by painstakingly going through the details of their proposal, AquaGuard management considers the proposal details irrelevant!  They feel bound only by what they later write into their Contract. While legally they can make that case, is that what most consumers believe?  With regard to performance of the work, which might be what matters most to the customer, most materials or services described to us were either downsized or done poorly if done at all! Here’s a partial comparison.

Properly Constructed Trench Path Narrow, Shallow Dirt Hole Everything about this “perimeter” system is wrong. The path is too narrow and too shallow. The drain pipe lies in dirt instead of being surrounded by gravel. Crushed stone used instead of gravel. Functional Sump Pump Enclosures Poorly Constructed, Damaged, and Improperly Installed Everything about this enclosure is wrong. Here’s a partial list: Smaller sump pump than in proposal, smaller enclosure, haphazard slashing of drain pipe entry holes lets stones fall into pit to the potential hazard of the pump, enclosure damaged by intentional drilling of holes in the bottom rendering water collection useless.     Isn’t this sort of thing illegal? Doesn’t anybody at AquaGuard care about how good a job they do?

    I don’t know about “illegal” but I would say I expected more from a company that claims to be a “family owned” business on their web site and “The Trusted Name in Waterproofing”. My complaints were first met with denial and then delaying tactics.

    As most, pretty much ALL interior drainage companies do, they misrepresent the actual problem(s) in order to sell, install the ONE thing they do, Misrepresenting the problem(s) for self gain equals FRAUD. These companies omit/obscure material facts all the time, we’ve seen it over and over for 35+ years. They tell homeowners all kinds of lies/nonsense, some of which Russ mentioned. Been posting for quite a few years to try and help inform homeowners at http://www.nachi.org ‘structural’. Been trying to get ‘the word out’ on these misfits for a long time so, here to help anyone.
